Welcome to AthleticScholar LLC ("AthleticScholar," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our platform, services, and website at athleticscholar.net (the "Service"). By accessing or using AthleticScholar, you agree to be bound by these Terms. If you do not agree, do not use our Service.

Eligibility

• • You must be at least 13 years old to use AthleticScholar.
• • By using our Service, you confirm that you meet this requirement.
• • If you are under 18, you confirm that you have permission from a parent or guardian to use AthleticScholar.

Account Registration and Management

• • Users must create an account to access certain features, including AI-powered messaging and coach discovery.
• • You are responsible for maintaining the confidentiality of your account and all activities under it.
• • Sharing account credentials or unauthorized use of another user's account is strictly prohibited.
• • If you believe your account has been compromised, contact support immediately.
• • If you wish to delete your account, email admin@athleticscholar.net from the email address on your account. Deleting an account is permanent and will remove your associated data as described in our Privacy Policy.

Services Provided

AthleticScholar is dedicated to transforming the college recruitment process for athletes. Our platform allows users to:

• • Discover Colleges: Search for colleges tailored to their sport, gender, and state.
• • Connect with Coaches: Directly reach out to college coaches to enhance recruitment chances.
• • AI-Powered Messaging: Generate personalized, coach-specific messages to make outreach more effective.
• • Automatic Sending: Have messages and follow-ups sent to relevant coaches automatically on your behalf.
• • Reply Tracking: See coach replies to your messages in your dashboard.

AthleticScholar does not guarantee recruitment, scholarships, or responses from coaches. Our platform serves as a tool to streamline communication and increase exposure to college programs.

Connecting Your Google Account

To send messages on your behalf, AthleticScholar asks you to connect your Google account and grant permission to send email and to check for replies to the messages we send for you.

• • By connecting your Google account, you authorize AthleticScholar to send emails from your Gmail account to the college coaches you choose to contact, and to access replies and related messages in those conversations.
• • The messages we send appear in your Gmail account and are sent under your name and email address. You remain the sender and are responsible for them.
• • You can revoke this permission at any time by disconnecting Gmail in your dashboard or by removing AthleticScholar from your Google Account permissions. When you do, we stop sending messages and checking for replies.
• • How we use the information we receive from Google is described in our Privacy Policy. AthleticScholar's use and transfer of information received from Google APIs adheres to the Google API Services User Data Policy, including the Limited Use requirements.
• • You must follow Google's terms and policies when you use your Google account with AthleticScholar. We may slow down or pause sending to protect your account and stay within Google's limits.

Automatic Sending

When automatic sending is turned on, you authorize AthleticScholar to send messages and follow-ups to coaches from your Gmail account on your behalf, using the profile information you provide. We spread messages out over time and stop follow-ups once a coach replies. You can pause automatic sending or disconnect Gmail at any time. You are responsible for keeping your profile information accurate and up to date, because our messages rely on it.

User Responsibilities and Prohibited Activities

Users agree to use AthleticScholar responsibly and refrain from engaging in prohibited activities, including but not limited to:

• • Misuse of AI Messaging: Sending inappropriate, misleading, or deceptive messages, or providing false information in your profile.
• • Spamming Coaches: Excessive or irrelevant messages that may result in blocked communications.
• • Web Scraping and Unauthorized Data Collection: Extracting or copying content, databases, or any portion of the platform without permission, including coach and college information.
• • Abuse of Platform Features: Using automated scripts, bots, or any mechanism to exploit the system.
• • Using the Service to violate any law, or to violate the rules of any athletic association or recruiting regulation that applies to you.

AthleticScholar only facilitates messaging between athletes and coaches; we do not control or monitor direct interactions.

Subscriptions and Payments

• • AthleticScholar operates on a subscription-based model. Plans are billed monthly or annually, as shown when you choose a plan.
• • New subscriptions may start with a free trial. The length of the trial is shown at checkout. A payment method is required to start a trial. To confirm your card, we may place a temporary authorization hold on it, which is released right away. You are not charged for the hold.
• • Unless you cancel before the trial ends, your subscription continues and your card is charged the plan price shown at checkout. We remind you before you are billed.
• • Subscriptions renew automatically at the end of each billing period until you cancel. You can cancel at any time in your account settings, and cancellation takes effect at the end of the current period.
• • Users agree to pay all applicable fees associated with their selected plan. Payments are processed securely by our payment processor, Stripe.
• • Refunds are issued at AthleticScholar's discretion. Users may contact support to request a refund, which will be evaluated on a case-by-case basis.

Parents and Guardians

A parent or guardian may pay for an athlete's subscription. The person who pays is responsible for the charges and can contact us to cancel or ask about billing. The athlete owns and uses the account, connects their own Gmail, and is responsible for the messages sent from it.

Intellectual Property

• • All content on the platform, including AI-generated messages, branding, software, and databases, is the exclusive property of AthleticScholar, except for content you provide.
• • You keep ownership of the information and content you provide, and you give us permission to use it to operate the Service for you.
• • Users may not reproduce, distribute, modify, or exploit any content for commercial purposes without written permission.
• • Unauthorized use of AthleticScholar's intellectual property may result in legal action.

Third-Party Logos and Images

• • AthleticScholar may display school names, logos, and images for informational purposes.
• • We do not claim ownership of any third-party trademarks, logos, or images used on the platform.
• • All intellectual property rights remain with their respective owners, and AthleticScholar provides full credit where applicable.
• • Any institution that wishes to have its logo or content removed may contact support, and we will promptly comply with valid requests.

Disclaimers and Liability Limitations

• • AthleticScholar does not guarantee college recruitment, athletic scholarships, or positive responses from coaches.
• • AI-generated messages are provided as a tool to assist outreach efforts. You are responsible for the accuracy of the information in your profile and for reviewing your messages in your dashboard.
• • The platform is provided "as is" without warranties of any kind. To the fullest extent allowed by law, AthleticScholar is not liable for any damages resulting from the use of the Service.

Privacy and Data Collection

• • AthleticScholar collects and processes personal data in accordance with our Privacy Policy.
• • We do not sell personal data to third parties.
• • By using the platform, you agree to the collection and use of information described in the Privacy Policy.

Termination

You may stop using AthleticScholar at any time. We may suspend or end your access if you break these Terms, misuse the Service, or put other users, coaches, or the Service at risk. If your access ends, we stop sending messages on your behalf.

Dispute Resolution

• • All disputes shall be resolved through binding arbitration in the state of Colorado.
• • By using AthleticScholar, users waive their right to participate in class-action lawsuits.

Changes to These Terms

• • AthleticScholar reserves the right to update these Terms at any time.
• • Users will be notified of significant changes, and continued use of the Service constitutes acceptance of the revised Terms.
